Eindrapport Inspectieonderzoek Zicht op zaken in Curaçao

Willemstad, 6 maart 2015 – In het jaarplan van de Raad is bepaald dat in 2014 een doorlichtingsonderzoek zal worden gedaan van het Openbaar Ministerie Curaçao (OM). De Raad heeft met de inspectie de sturing en toezicht door het OM op de selectie van strafzaken en de voortgangs- en kwaliteitsbewaking van opsporingsonderzoeken onderzocht.

In dit rapport worden de bevindingen gepresenteerd omtrent de wijze waarop sturing en toezicht worden gegeven door het Openbaar Ministerie op de selectie van strafzaken en de voortgangs- en kwaliteitsbewaking van opsporingsonderzoeken. Het gehele bovengenoemde proces wordt ook wel aangeduid als “zicht op zaken”. Hierna volgt een korte beschrijving van de bevindingen en conclusies van het rapport.

Opsporingsinformatie bij het Korps Politie Curaçao (KPC) doorloopt vanaf de aanvang een proces waarin op meerdere momenten keuzes worden gemaakt. Zicht op zaken heeft vooral betrekking op de keuzemomenten (= stuurmomenten) in het opsporingsproces. Wanneer worden welke keuzes gemaakt, door wie, op basis waarvan en welk effect heeft dat op de kwaliteit van de sturing. Het betreft hierbij het gehele traject vanaf het moment van het opnemen van een aangifte door de politie of het OM, of het registreren van eigen waarnemingen of meldingen, tot en met het aanbieden van het dossier met procesverbaal door de korps politie aan het OM. Gedurende de inspectie heeft de Raad geconstateerd dat de kwaliteit van zicht op zaken afhankelijk is van diverse aspecten, waaronder de informatievergaring en informatieverwerking.

De Raad heeft geconstateerd dat er steeds meer aangiften worden gedaan bij het OM waarbij het volgens het OM meestal gaat om politiek gerelateerde aangiften.

De Raad heeft bevonden dat er geen vaste en vastgelegde afspraken zijn over de overlegmomenten tussen het OM en het KPC, waardoor de overlegmomenten afhankelijk zijn van de betrokken officier van justitie en de voorraad zaken die er ligt. Tevens is gebleken dat de diverse keuze- en sturingsmomenten niet formeel door het OM zijn geïdentificeerd en vastgelegd. De Raad concludeert dat de keuze- en sturingsmomenten door het KPC wél in hun inrichtingsplan zijn geïdentificeerd en vastgelegd.

Gedurende het onderzoek heeft de Raad geconstateerd dat er binnen beide organisaties geen duidelijk en eenvormig beeld is wanneer er sprake is van pre-screening en/of case-screening. Tijdens het onderzoek is ook komen vast te staan dat er bij het KPC geen vastgestelde criteria zijn op grond waarvan brengzaken / incidentgerichte onderzoeken worden geselecteerd, geprioriteerd, evenmin op grond waarvan onderzoeken worden ingesteld (case-screening). Gebruikelijk is dat de desbetreffende OvJ zelf beslist wat hij / zij wel of niet wil selecteren of onderzoeken. Door zowel het KPC als het OM worden de drie screeningscriteria (bekende dader, maatschappelijk impact, beleidsprioriteiten van de overheid) genoemd maar in de praktijk blijkt dat deze door het KPC slechts in de fase van pre-screening worden toegepast.

Het KPC heeft gedurende het onderzoek tevens aangegeven dat mede door het ontbreken van vastgestelde weegcriteria in de selectie en prioritering van zaken de objectiviteit bij de besluitvorming niet voldoende wordt gewaarborgd.

Plankzaken (dit zijn zaken die niet meteen worden onderzocht) liggen bij het KPC en worden periodiek door het OM en het KPC alsnog beoordeeld en afgedaan. Uit het onderzoek is echter komen vast te staan dat er geen beleid is voor de pre-screening van de plankzaken.

In verband met de schaarse beschikbare capaciteit moet door het KPC volgens planvorming worden beslist over de verdeling van de beschikbare capaciteit. Tijdens het onderzoek is komen vast te staan dat het OM geen sturing geeft aan beslissingen terzake van het KPC. Het OM is echter indirect betrokken bij dit proces. Het OM kan immers aangeven met welke opsporingsambtenaren de samenwerking in eerdere onderzoeken naar tevredenheid is verlopen.

Ook is uit het onderzoek gebleken dat naast de zaken die door het OM zijn geselecteerd voor verder onderzoek, het KPC vaak geconfronteerd wordt met verzoeken van individuele officieren van Justitie om ook zaken die niet door de screening zijn gekomen met de nodige spoed af te ronden. Dit wordt door het KPC als een knelpunt ervaren, aangezien deze verzoeken niet of moeilijk kunnen worden afgewezen.

Volgens artikel 32 van de Rijkswet Politie dienen criminaliteitsbeeldanalyses van de landen onder verantwoordelijkheid van de Procureur-Generaal tot stand te komen. Het is gebleken dat het KPC in tegenstelling tot het OM hieraan geen invulling geeft. Onder verantwoordelijkheid van het OM wordt wel periodiek een criminaliteitsbeeldanalyse uitgevoerd.

Het KPC heeft aangegeven dat zij wel beschikken over criminaliteitscijfers, maar dat er geen analyse is gedaan van de beschikbare cijfers door gebrek aan expertise. Het gaat hierbij om de reeds in het inspectieonderzoek opsporingsproces (uitgevoerd door de Raad in 2013) aangeduide analyse van de leefbaarheid en veiligheidsproblematiek op buurtniveau. Deze analyses moeten vervolgens door het KPC in wijkveiligheidsplannen worden verwerkt. De Raad is van mening dat ook het KPC in de nabije toekomst in staat moet zijn om zelfstandig strategische / criminaliteitsanalyses te maken.

De Raad is tot de conclusie gekomen dat sturing door het OM het meest tot uiting komt gedurende de opsporingsfase, waarbij het KPC nauw moet samenwerken met het OM teneinde gebruik te kunnen maken van de diverse dwangmiddelen.
