Eindrapport Inspectieonderzoek Aanpak van de bestrijding van Atrako's in Curaçao

Willemstad, 25 januari 2016 – De opzet van de atrako-bestrijding in Curaçao is overzichtelijk en de aansturing ervan helder. Ook de bevoegdheden voor de functionarissen in het veld zijn goed geregeld terwijl de onderzoeken die kúnnen worden verricht, van degelijke kwaliteit zijn. Verder is het ook positief dat de aanpak in zowel de preventieve sfeer als in de repressieve sfeer (met verhoogde straffen) doorwerkt. Dit zijn enkele van de sterke kanten aan de aanpak.

Dat stelt de Raad voor de Rechtshandhaving na inspectie van het beleid dat het Korps Politie Curaçao (KPC) en het Openbaar Ministerie (OM) implementeren om vorm te geven aan de organisatie, processen en acties voor de atrako-bestrijding in Curaçao. De Raad deed onderzoek hiernaar omdat atrako’s een grote impact hebben op de slachtoffers, het veiligheidsgevoel van de samenleving aantasten en de economie deren – onder meer door het imago van het land Curaçao te schaden, wat slecht is voor het toerisme.

Meer mensen en middelen nodig
Maar de Raad constateerde ook minder sterkte kanten aan de atrako-bestrijding. Zo zijn er bij het KPC vier teams, die onder de Divisie Informatie en Ondersteuning en de Divisie Georganiseerde Criminaliteit vallen, die het Atrako-team intern moeten ondersteunen: het Observatie Team, de Arrestatie en Ondersteuning Eenheid, de Technische Ondersteuning en de Forensische Ondersteuning. De twee laatste kampen echter met gebrek aan personeel waardoor hun ondersteuning aan het Atrako-team niet zoals is ingepland verloopt.

Verder worden de activiteiten van het Atrako-team belemmerd omdat het personeel van één van de externe ondersteunende diensten slechts medewerking verleent gedurende normale werktijden en dat alleen voor zover de daarvoor benodigde menscapaciteit er is.
Het ontbreekt het Atrako-team ook aan financiën om haar technische opsporingsmiddelen te onderhouden en om kantoormiddelen en transport te bekostigen. Het Land Curaçao heeft daarnaast een schuld bij het Nederlands Forensisch Instituut terwijl ook de inzet van een (lokale) patholoog voor het verrichten van secties bemoeilijkt wordt door geldgebrek.

Verder zijn er knelpunten bij de deelprocessen registratie en screening van de incidentgerichte opsporing. Het screenen van aangiften geschiedt niet door de Infodesk maar door het Atrako-team zelf, samen met de Officier van Justitie. Er is geen applicatie voor de module opsporing in het Actpolsysteem, waardoor geen automatische overzichten kunnen worden geproduceerd.
Een stuurgroep is belast met de uitvoering van de deelprocessen prioriteren, kiezen en vaststellen, monitoren en evaluatie van het proces. probleemgerichte opsporing. De taken worden echter niet uitgevoerd.

Cellen en dossiers
Wat ook te wensen over laat is, onder andere, de beschikbare celcapaciteit. Van de drie beoogde celfaciliteiten – op Barber, bij de Sentro di Dentenshon i Korekshon Kòrsou en op Rio-Canario – is dat op Rio Canario afgevallen in verband met een verbouwing. Daarvóór was het opsluiten van atrako-verdachten daar overigens niet mogelijk zonder toestemming van het OM omdat die cellen bedoeld waren voor ‘bolita’-slikkers (drugskoeriers).

De Raad vindt het ook minder sterk dat het Rapport Eindtermen Politieonderwijs, dat onder andere de benodigde competenties en kennis voor opsporing vaststelt, niet wordt geïmplementeerd. De onderzoeken en aangiften van atrako’s zijn welliswaar op niveau, maar de dossiervorming van complexe onderzoeken moet beter.
