Knelpunten bij Immigratie en Grensbewaking nog niet opgelost

(Philipsburg, Sint Maarten) – Een review door de Raad voor de rechtshandhaving heeft aangetoond dat vier van de zes knelpunten vastgesteld in een eerder rapport op het gebied van toelating en uitzetting bij de Immigratie en Grensbewaking Dienst (IGD) in Sint Maarten nog niet zijn opgevolgd.

In 2014 heeft de Raad voor de rechtshandhaving een rapport gepubliceerd over de toelating en verwijdering van vreemdelingen op Sint Maarten, met de nadruk op aanvragen met betrekking tot het verrichten van werk. In het rapport heeft de Raad zes aanbevelingen aan de minister van Justitie gedaan om de vastgestelde knelpunten op het gebied van toelating en uitzetting bij de IGD op te lossen. In 2019 nam de Raad een review van dit rapport op in zijn jaarplan, waarin opvolging van de aanbevelingen centraal stond. De algemene conclusie van deze review was dat van de zes aanbevelingen uit 2014 het merendeel niet (volledig) is opgevolgd.

Opgevolgd

De opgevolgde aanbeveling heeft betrekking op de upgrade naar het dossier-registratie- en volgsysteem ‘Decos Join’ waarmee onder andere alle bestanden vlot getraceerd kunnen worden en beter inzicht verkregen wordt in zowel de aard en omvang van de totale instroom van vreemdelingen in Sint Maarten als de in Sint Maarten verblijvende vreemdelingen. De Raad is tevreden met deze belangrijke stap richting digitalisering.

Gedeeltelijk opgevolgd

De aanbeveling die gedeeltelijk is opgevolgd, bestaat uit twee delen en betreft enerzijds het investeren in het opleiden van medewerkers met betrekking tot het herkennen van vervalste documenten en het gebruik maken van lokale kennis en anderzijds het onderzoeken van mogelijkheden voor een database met de meest voorkomende vervalste documenten uit de meest voorkomende landen van herkomst. Op diverse gebieden zijn opleidingen verzorgd en er wordt gebruik gemaakt van lokale kennis, maar door het gebrek aan financiën is er niet geïnvesteerd in de bovengenoemde database die mogelijk de herkenning van vervalsingen door medewerkers ten goede zou kunnen komen.

Niet opgevolgd

Vier van de zes aanbevelingen zijn niet opgevolgd. De eerste aanbeveling betreft samenwerking tussen ministeries op het gebied van een arbeidsmarktstudie en het op basis daarvan formuleren van een arbeidsmarktbeleid en een toelatingsbeleid. De tweede aanbeveling houdt verband met het laatstgenoemde en betreft het zorgen voor een effectieve uitvoering en handhaving van het (toelatings-)beleid. De hoofdreden voor het gebrek aan follow-up van deze twee aanbevelingen is de omstandigheid dat hoewel de aanbevelingen aan het ministerie van Justitie zijn gericht, er deels ook medewerking en bereidwilligheid van zowel het ministerie van Volksgezondheid, Sociale Zaken en Arbeid VSA als het ministerie van Justitie vereist is voor opvolging.

De Raad meent dat het belangrijk is dat de twee ministeries samenwerken om ervoor te zorgen dat de aanbeveling wordt opgevolgd en te waarborgen dat de noodzakelijke justitiële visie niet verloren gaat bij het uitvoeren van de arbeidsmarktstudie en bij de voorbereiding van beleid.

De derde aanbeveling die niet is opgevolgd betreft het formuleren en publiceren van beleid. Onder meer de richtlijnen van het ministerie van Justitie zijn nog niet bijgewerkt en gepubliceerd.

Ook niet opgevolgd is de aanbeveling betreft enerzijds de harmonisatie van vereisten in wetgeving, beleid en het aanvraagformulier dat wordt gebruikt voor het aanvragen van een verblijfsvergunning en anderzijds de besluitvormings- en verwijderingspraktijk van de IGD. Er is nog steeds een discrepantie tussen de eisen die gesteld worden op de aanvraagformulieren en de door de IGD vereiste documenten in de praktijk.

De Raad zal de ontwikkelingen in de komende periode blijven volgen, maar is zich bewust van de moeilijke tijden die Sint Maarten momenteel doormaakt als gevolg van de COVID 19 pandemie en de druk die dit veroorzaakt op de verschillende (justitiële) organisaties. Hoewel de realisatie van bovengenoemde aanbevelingen op korte termijn wellicht niet haalbaar is, hoopt de Raad dat de focus op het verbeteren van de geconstateerde knelpunten op de (middel) lange termijn niet verloren gaat.

De Raad wil ook van deze gelegenheid gebruik maken om al onze frontliners te bedanken voor al hun inzet.
