PHILIPSBURG, Sint Maarten–De Landsrecherche Sint Maarten (LSM) voldoet niet aan de meest essentiële randvoorwaarden (financieel, materieel en personele middelen) om te kunnen functioneren. Tot die conclusie kwam de Raad voor de rechtshandhaving (hierna: de Raad) in zijn laatste inspectierapport over de LSM.

“De Raad constateert dat de LSM op dit moment niet in staat is om (zelfstandig) haar wettelijke taken (optimaal) uit te voeren. De basisvoorwaarden daarvoor ontbreken”, stelt de Raad in een vandaag gepubliceerd rapport. De Raad concludeert dan ook dat, “Ondanks de plannen over de opbouw van de dienst is er 10 jaar na de oprichting van een eigen Landsrecherche voor Sint Maarten nog steeds sprake van diverse serieuze knelpunten. De voornaamste doelstelling, een volwaardige dienst, is niet behaald”.

Problematisch functioneren

De Raad onderzocht in deze inspectie in hoeverre de Landsrecherche is toegerust om haar taken uit te voeren. Volgens de Raad is het functioneren van de LSM op alle vlakken problematisch. Het ontbreekt aan beleid, beheer en sturing. De middelen van de LSM zijn niet adequaat om de doelstellingen te behalen, waarbij het structureel tekort aan budget een grote rol speelt. De onafhankelijkheid van de dienst is niet voldoende gewaarborgd.

De aanbevelingen die de Raad en andere instanties in de diverse rapporten deed over deze knelpunten zijn niet of nauwelijks opgevolgd. De Raad vindt dit zeer zorgelijk gezien de taken en belangrijke rol van de LSM. “Ondanks dit alles blijft het personeel zich inzetten voor de dienst, maar het verdient ook een (veilige) werkplek om zijn taken naar behoren uit te voeren”.

De diverse plannen voor de oprichting en doorontwikkeling van de LSM, het Inrichtingsplan met bijbehorend Implementatieplan en het Verbeterprogramma Openbaar Ministerie (OM), hebben niet geleid tot het gewenste resultaat, namelijk een volwaardige dienst. Het wettelijke kader van de Landsrecherche is voor het overgrote deel up-to-date, maar er zijn knelpunten voor wat betreft de rechtspositie van het personeel, en er is nog steeds geen geformaliseerd functieboek.

Concreet beleid

Er is door de minister geen concreet beleid geformuleerd wat van de Landsrecherche wordt verwacht, met als gevolg een negatief effect op onder meer de uitvoering van de taken en samenwerking met stakeholders. Voor de organisatie betekent het dat onvoldoende gestuurd kan worden op prestaties en prioriteiten die idealiter door de minister, de Procureur-Generaal (P-G) en de LSM gezamenlijk, eensluidend en zo concreet mogelijk horen te worden geformuleerd en waarover verantwoording kan worden afgelegd.

Het OM heeft in de afgelopen jaren de sturing ten aanzien van de opsporing door de Landsrecherche willen intensiveren door middel van de Coördinatie Commissie Landsrecherche (CCLR) en de Aanwijzing taken en inzet Landsrecherche. Toch maakt de Raad zich zorgen. Het overleg door de CCLR vond een aantal maanden niet consequent plaats. Voorts is de communicatie tussen de LSM en het OM niet optimaal wat gevolgen heeft voor de onderzoeken die gedraaid worden.

Integriteitsonderzoeken

De Raad vindt dat de LSM voor het doen van onderzoek naar integriteitsschendingen nog niet de positie binnen de rechtshandhaving heeft verworven die zij wenst, terwijl de LSM voor de signalering en aanpak van de integriteitsproblematiek op Sint Maarten een van de, zo niet de meest relevante opsporingsdienst is. Hier ziet de Raad een taak voor de minister evenals de P-G om (meer) werk te maken van de aansturing van de Landsrecherche. Er zijn op strategisch niveau diverse platforms hiervoor beschikbaar, onder andere het driehoeksoverleg, het beheersoverleg en het Justitieel Vierlanden Overleg (JVO).

Er moet meer geïnvesteerd worden in cruciale middelen zoals een bedrijfsprocessensysteem en in het vergroten van de huidige kennis en capaciteit door middel van opleidingen en het werven van personeel. De LSM is sterk afhankelijk van de ondersteuning door het Recherche Samenwerkingsteam RST en het Team Bestrijding Ondermijning (TBO) op het gebied van mensen en middelen. “Hoewel dat op dit moment noodzakelijk is door het gebrek aan capaciteit en expertise en de samenwerking een goede zaak is, zou het uitlenen van personeel door het RST geen langetermijnoplossing moeten zijn”, aldus de Raad.

De Raad waardeert de interne aandacht die de organisatie terecht aan het thema integriteit schenkt. Die aandacht uit zich onder meer in het introduceren van een gedragscode voor personeel en het in kaart brengen van hun nevenactiviteiten.

Onvoldoende middelen

De Landsrecherche kampt met budgettaire problemen. Volgens het ministerie van Justitie is de financiële situatie van het Land Sint Maarten een gegeven waardoor het budget van de LSM de afgelopen jaren vrijwel hetzelfde is gebleven. Als gevolg hiervan heeft de LSM niet de nodige materiele en personele investeringen kunnen doen, zoals investeringen in de voor de werkzaamheden benodigde middelen waaronder het wagenpark, materieel en benodigdheden in en om het gebouw. Verder blijkt het kwalitatief invullen van vacatures van essentieel belang voor het volwassen worden van de organisatie. Zo is de functie van hoofd nu weer vacant wat gevolgen heeft voor de aansturing van onderzoeken. De voornoemde knelpunten zorgen bij medewerkers voor de nodige frustraties. Daarnaast ervaart het personeel knelpunten door het ontbreken van een geformaliseerde rechtspositie, onder meer met betrekking tot hun landsbesluiten, bevorderingen en remuneratie.

Samenwerking

De samenwerking met lokale ketenpartners zoals het Korps Politie Sint Maarten (KPSM) en het Meldpunt Ongebruikelijke Transacties (MOT) wordt als goed ervaren. Er is sprake van beperkte samenwerking met overheidsdepartementen zoals de Belastingdienst en de Basisadministratie. De LSM werkt graag toe naar een hechtere samenwerking met deze diensten en zet graag stappen hiertoe.

In dit kader geeft de Raad aan dat: “Het is de Raad gebleken, dat er op ministerieel niveau al jaren wordt gesproken over de wenselijkheid en haalbaarheid van het intensiveren van de samenwerking tussen de zusterdiensten binnen het Koninkrijk. Echter heeft dit nog niet tot concrete resultaten geleid. Gezien de kleinschaligheid van de landen vindt de Raad dit een gemis. De Raad constateert dat alle organisaties de noodzaak van samenwerking onderkennen, maar dat ze het erover eens zijn dat ze elkaar weinig te bieden hebben zolang de eigen beperkingen niet worden geadresseerd. De Raad is van mening dat de knelpunten die een intensievere samenwerking tussen de organisaties in de weg staan, zo snel mogelijk verholpen moeten worden”.

Aanbevelingen

Het inspectieonderzoek van de Raad richtte zich op de juridische inbedding, de organisatiestructuur, (personeel en materiële) middelen, de samenwerking met andere instanties en de resultaten. De onderzoeksresultaten leidde tot zeventien aanbevelingen gericht aan de minister van Justitie van Sint Maarten. De kernboodschap van de Raad is dat hij de Minister nogmaals aanbeveelt, om structureel werk te maken van de doorontwikkeling van de Landsrecherche.

De minister wordt gevraagd om, onder andere, de rechtspositieregeling voor de LSM te regelen, het functieboek van de LSM te formaliseren, ervoor te zorgen dat de LSM op sterkte komt volgens het vastgestelde formatieplan, zorg te dragen voor een algemeen politiek-bestuurlijk beleid ten aanzien van de Landsrecherche waarbij een behoorlijke taakuitvoering en een adequate infrastructuur voor een doeltreffend ondersteunend beheer in acht wordt genomen, genoeg middelen in de begroting te reserveren in overeenstemming met de behoefte van de dienst, en de samenwerking tussen de LSM en zusterdiensten te bevorderen.

Aan de minister wordt ten aanzien van het Parket van de PG en het OM aanbevolen om, onder andere, een evaluatie uit te voeren van het verbeterplan Landsrecherche, ervoor te zorgen dat de Landsrecherche in alle gevallen waarin de dienst volgens de wet bevoegd is wordt ingeschakeld en te zorgen voor een sterke(re) positionering van de Landsrecherche tijdens de daarvoor bestemde platforms zoals het JVO.
