Raad voor de rechtshandhaving: Algehele opvolging aanbevelingen strafrechtelijk beslag in korte tijd mogelijk

(Philipsburg, Sint Maarten) – Drie van de zeven aanbevelingen die de Raad voor de rechtshandhaving in 2014 heeft gedaan in een rapport naar aanleiding van zijn inspectie van het onderwerp strafrechtelijk beslag in Sint Maarten zijn volledig opgevolgd. Vier aanbevelingen zijn deels opgevolgd.

Centraal in de inspectie die de Raad deed in 2014 stond de vraag wat de procedure is met betrekking tot het beheer van inbeslaggenomen voorwerpen en in hoeverre de veiligheid en transparantie van het beheer van deze voorwerpen geborgd is. Op basis van de bevindingen uit dat rapport zijn zeven aanbevelingen ter verbetering van het proces strafrechtelijk beslag geformuleerd. In 2019, vijf jaar na publicatie van het rapport, heeft de Raad in een reviewrapport geëvalueerd op welke wijze de minister van Justitie en de desbetreffende organisaties gevolg hebben gegeven aan de zeven aanbevelingen van de Raad.

De minister en betrokken organisaties hebben drie aanbevelingen opgevolgd op het gebied van procesbeschrijving, de lijst van inbeslagname en de toezichtstaak bij vernietiging van risicovolle voorwerpen. Voor de vier deels opgevolgde aanbevelingen geldt dat stappen zijn gezet in de gewenste richting op het gebied van de opslag van grote voorwerpen, de vaststelling van het functieboek van het Korps Politie Sint Maarten, het informeren over inbeslagname en de afhandeling van inbeslaggenomen voorwerpen. Hoewel algehele opvolging van de aanbeveling over het functieboek meer tijd in beslag zal nemen gezien de zwaarte van de materie en de bijbehorende (wetgevings-)procedures en implementatie, is de Raad optimistisch gestemd dat algehele opvolging van de andere aanbevelingen in relatief korte tijd alsnog mogelijk is. De Raad zal de ontwikkelingen nauwlettend volgen.

Het reviewrapport is ruim zes weken geleden aangeboden aan de minister van Justitie om hem overeenkomstig de wettelijke procedure in de gelegenheid te stellen om het rapport vergezeld van zijn reactie aan te bieden aan de Staten van Sint Maarten. Het reviewrapport is gepubliceerd op de website van de Raad voor de rechtshandhaving:
