Willemstad, 29 april 2015 – De Raad voor de Rechtshandhaving (Raad) is bij rijkswet ingesteld. De Raad is een onafhankelijk inspectieorgaan en inspecteert het functioneren van de justitiële keten in de landen Curaçao en Sint Maarten en op Bonaire, St. Eustatius en Saba. De Raad ziet toe op het functioneren van de organisaties binnen de justitiële keten, de ketensamenwerking tussen deze organisaties in de landen en de samenwerking tussen de landen.
De Raad kan inspectie verrichten met betrekking tot de volgende instanties:
* De politie, het opleidingsinstituut van de politie en het Openbaar Ministerie;
* Instellingen en inrichtingen waar vrijheidsstraffen, vrijheid benemende maatregelen of vrijheidbeperkende maartregelen ten uitvoer worden gelegd, of reclassering dan wel slachtofferzorg plaatsvindt;
* Andere bij landsverordening of bij wet aangegeven organisaties die onder de verantwoordelijkheid van de in de Rijkswet bedoelde minister vallen en deel uitmaken van de justitiële keten.

De Raad voert inspecties uit met betrekking tot de effectiviteit, de kwaliteit van de taakvoering en het beheer. De Raad beschikt over wettelijke bevoegdheden en voert zijn werkzaamheden uit, onafhankelijk van de betrokken instellingen en de verantwoordelijke Ministers. Ministers kunnen wel, na overleg met de Raad, aanwijzingen geven met betrekking tot de uitvoering van het jaarplan van de Raad. De Raad voert zijn werkzaamheden uit op basis van een protocol. In dit protocol wordt inzicht gegeven in de te hanteren procedure en zorgvuldigheidsregels, die de Raad in acht moet nemen bij het uitvoeren van de inspectietaak.
Jaarlijks brengt de Raad ingevolge artikel 33 van de Rijkswet Raad voor de Rechtshandhaving op 1 mei verslag uit over de staat van de rechtshandhaving.

Overzicht van werkzaamheden sinds instelling
De periode na 10 oktober 2010 stond in het teken van de opbouw van de Raad en het secretariaat. De eerste inspectie van de Raad werd in oktober 2011 verricht. In 2012 en 2013 kreeg de Raad in toenemende mate inzicht in het functioneren van de verschillende justitiële organisaties. In die periode voerde de Raad een doorlichting uit bij een aantal organisaties en heeft daarnaast enkele thematische inspecties uitgevoerd. Op onderdelen gingen deze inspecties ook in op de samenwerking met ketenpartners.

Zowel de staatkundige veranderingen, waarbij het functioneren van de justitiële keten een autonome verantwoordelijkheid werd van de landen, alsmede de vernieuwing van de wet- en regelgeving, werkten door in het functioneren van de betrokken instanties.

Overzicht van uitgebrachte adviezen in 2014
In 2014 heeft de Raad 8 inspecties uitgevoerd op Curaçao. In de onderzoeken op Curaçao kwam de Raad tot de volgende aanbevelingen:
* Aangifteproces: De Raad concludeerde dat het merendeel van de aanbevelingen uit het inspectierapport van de Raad van medio 2012 niet was opgevolgd. De Raad heeft wederom aanbevelingen gedaan in de hoop dat de verbeteringen op korte termijn opgevolgd worden;
* Beheer van in beslag genomen goederen: De Raad constateerde in dit rapport dat de wijze waarop een aantal van de betrokken instanties op Curaçao omgaan met de in beslag genomen goederen niet in overeenstemming is met de wettelijke procedure. De Raad heeft hierbij ook het beheer van in beslag genomen goederen inzichtelijk gemaakt;
* Toepassing politiegeweld: Aangezien toepassing van geweld door de politiegrote impact kan hebben op zowel de betrokken agent, de burger(s)en het gehele korps heeft de Raad beoogd middels dit onderzoek om de organisatie daar omtrent inzichtelijk te maken en tevens na te gaan of de gestelde regels worden nageleefd en of er voldoende waarborgen bestaan om ongeoorloofd geweld te voorkomen en aan te pakken. Dit rapport is aan de Minister aangeboden en wordt binnenkort gepubliceerd;
* Executie strafrechtelijke vonnissen: Het doel van dit onderzoek was om inzicht te bieden in de wijze waarop strafvonnissen ten uitvoer worden gelegd. De Raad heeft bij dit onderzoek geconstateerd dat het toezicht van het OM op de uitvoering van vonnissendoor SDDK, kan worden verbeterd en heeft daartoe ook aanbevelingen gedaan;
* Beveiliging van gezagsdragers::Het doel van dit onderzoek is om de wijze waarop de beveiliging van gezagdragers is geregeld, inzichtelijk te maken alsmede vast te stellen in hoeverre de beveiliging van gezagdragers voldoet aan de toepasselijke normen Dit rapport is aan de Minister aangeboden en wordt binnenkort gepubliceerd;
* Justitiële Jeugd Inrichting Curaçao: Het doel van deze inspectie was om inzicht te verkrijgen in de organisatie van de JJIC en de wijze waarop de taken worden uitgevoerd teneinde de doelstellingen te realiseren. Tijdens de inspectie is ook komen vast te staan dat de werkzaamheden van de medewerkers van de JJIC werden bemoeilijkt door het ontbreken van structurele bijscholing- en opleidingsmogelijkheden. De Raad concludeert dat ondanks de genoemde beperkingen de JJIC als bevoegde en aangewezen instantie conform de wet uitvoering gaf aan de rechterlijke maatregelen van OTS, PIJ en Jeugddetentie ten aanzien van minderjarigen.

* Infrastructuur ter bestrijding van corruptie: Het doel van deze inspectie is om inzicht te krijgen in de wijze en in de mate waarin het land Curaçao in staat is om corruptie te bestrijden. Dit rapport is aan de Minister aangeboden en wordt binnenkort gepubliceerd;

De Raad heeft op verzoek van de Minister van Justitie een inspectieonderzoek opgestart bij de Voogdijraad. Dit onderzoek zal op korte termijn worden afgerond.

Geplande werkzaamheden voor 2015
Voor 2015 heeft de Raad ook een volle agenda met inspecties die zijn voorgenomen. De volgende inspecties zullen op zowel Curaçao, Sint Maarten als de BES-eilanden worden uitgevoerd:
* Aanpak van de bestrijding van atrako’s: De inspectie richt zich op de vraag of de bevoegdheden van de organisatorische eenheden toereikend zijn om op een effectieve en efficiënte wijze de bestrijding van atrako’s uit te voeren;
* Preventie jeugdcriminaliteit: Het is van maatschappelijk zeer groot belang dat de overheid op een effectieve manier maatregelen neemt om te voorkomen dat jeugdigen crimineel gedrag gaan vertonen en vervolgens met Justitie en daarna met jeugdreclassering in aanraking komen;
* Behandeling van personen met psychiatrische stoornissen en verslavingsproblematiek in de strafrechtsketen: Dit onderzoek heeft met name betrekking op Brasami op Curaçao. De Raad vindt het van belang dat vanuit het oogpunt van de rechtspositie van de justiabele de maatschappelijke re-integratie en de maatschappelijke beveiliging en veiligheid, te beoordelen hoe het is gesteld met de behandeling van personen met psychiatrische stoornissen in de strafketen;
* Uitwisseling van politie- en justitiële gegeven in het Koninkrijk: De Raad zal onderzoek doen in hoeverre en op welke wijze de uitvoering van justitiële gegevens in het Koninkrijk plaatsvindt.

Op Curaçao zullen, aanvullend op de bovenvermelde onderzoeken de volgende specifieke onderzoeken worden verricht:
* Veiligheid binnen het gevangeniswezen: Op basis van gevoerde onderzoeken die de Raad in 2012 en 2013 heeft verricht naar detentie op Curaçao, heeft de raad voldoende gegevens verzameld om een onderzoek gericht op de veiligheid binnen het gevangeniswezen te rechtvaardigen;
* Politiecellen: De Raad ziet voldoende aanleiding om een specifiek onderzoek te doen naar de stand van zaken met betrekking tot de politiecellen om zo ook aanbevelingen te doen ter verbetering van de situatie;
* Vervolgings- en Sepotbeleid: In dit onderzoek wordt nagegaan in hoeverre de criteria die ten grondslag liggen aan het vervolging- en sepotbeleid in praktijk worden toegepast.
Op de BES-eilanden zal aanvullend op de algemene onderzoeken ook de volgende specifieke onderzoeken worden verricht:
* De effecten van tweetaligheid op rechtshandhaving: De Raad zal een onderzoek verrichten of, en zo ja welke effecten de tweetaligheid (Nederlands en Papiaments) heeft op rechtshandhaving.
