Veel aan aanpassing toe bij gevangenis SDKK - Raad voor de rechtshandhaving

WILLEMSTAD – Het ministerie van Justitie moet op korte termijn afdoende aandacht besteden aan het personeel van de gevangenis Sentro pa Detenshon i Korekshon Kòrsou (SDKK). Het gaat met name om de kwaliteit (waaronder kennis) en de kwantiteit van dat personeel en ook om het hoge ziekteverzuim. Verder moet het bewustzijn groeien ten aanzien van veiligheid en integriteit. Dit is goed voor de veiligheid van de gedetineerden, het personeel zelf en de Curaçaose bevolking.

Inspectierapport bij de minister
Dat beveelt de Raad voor de Rechtshandhaving aan, na een inspectieonderzoek in de SDKK. Het doel van dit onderzoek was om na te gaan in hoeverre de beveiliging van de inrichting alsook de veiligheid van het personeel en dat van de gedetineerden geregeld zijn.
Het inspectierapport is aan de minister van Justitie aangeboden en is, conform vigerende wetgeving, publiekelijk gemaakt. Daarin geeft de Raad aanbevelingen zoals bovengenoemd. Maar er is meer: de raad somt bijna vijftig punten op die snel moeten worden opgepakt door de minister of de SDKK. Het gaat om aspecten van wet- en regelgeving, beleid of (infra)structuur – maar ook om praktische zaken zoals: ‘draag zorg voor de verwijdering van struikgewas en jonge bomen nabij de ringmuur’, ‘draag zorg voor een adequaat sleutelbeheer’ en ‘draag zorg voor de nodige verlichting binnen de SDKK’.

‘Wet- en regelgeving aanpassen’
De Raad is van mening dat de huidige, penitentiaire wet- en regelgeving , die het handelen van de directeur van de SDKK omkadert, aan aanpassing toe is.
De penitentiaire wet- en regelgeving kent de directeur van de SDKK bevoegdheden toe om ongeregeldheden in de gevangenis te voorkomen of daaraan het hoofd te bieden. Ook heeft hij specifieke bevoegdheden en mogelijkheden om de orde, tucht, veiligheid en goede gang van zaken binnen de gevangenis te garanderen.

Afgestemd en bekendgemaakt
Voor wat betreft de procedurele beveiliging merkt de Raad op dat de SDKK niet over voldoende beleidsvoorschriften en –instructies beschikt. Er dienen op korte termijn op elkaar afgestemde beleidsplannen en -voorschriften te worden opgesteld en bekrachtigd. Zo ziet de Raad, bijvoorbeeld, graag dat alle bekleders van vertrouwensfuncties bij de SDKK zo snel mogelijk een veiligheidsonderzoek ondergaan en dat voortaan dit onderzoek vóór de indiensttreding wordt gedaan.

Inzake beveiliging komt de Raad voorts tot de conclusie dat er voortvarend gewerkt dient te worden aan aanpassingen op het gebied van personeel, infrastructuur en beveiligingsinstrumenten. Er moet snel een jaarlijkse evaluatie komen van beveiligings-, integriteits-, BHV-, calamiteiten- en ontruimingsplannen van de SDKK met, waar nodig, aanpassingen.

Interne communicatie
Ook is de Raad van mening dat het beleid onder het personeel bekend dient te zijn en dat de controle en de toezicht op de uitvoering ervan beter moet. Hiertoe moet de inrichting, om te beginnen, een communicatieplan opstellen en uitvoeren.
