WILLEMSTAD – De Raad heeft een onderzoek “Verkeerscontrole” uitgevoerd om vast te stellen in hoeverre verkeerscontroles bijdragen aan de veiligheid in het verkeer. De Raad concludeert dat justitie onvoldoende in staat is om de verkeersveiligheid optimaal te bevorderen en het aantal slachtoffers in het verkeer te verminderen en doet twintig aanbevelingen aan de minister van Justitie.

In het onderzoek zijn er verschillende knelpunten geconstateerd. Er is onvoldoende samenwerking (integrale aanpak) tussen de ministeries van Justitie en Verkeer Vervoer en Ruimtelijke Planning (VVRP), met name tussen het OM en KPC enerzijds en de Uitvoeringsorganisaties Openbare Werken (UOOW) en de Ruimtelijke Ordening en Planning (URO&P) anderzijds. Volgens de UOOW vloeit het verschil in opvatting voort uit het gebrek aan kennis bij de partners van de internationale ontwikkelingen over verkeersinfrastructuur en verkeersveiligheid. Er is ook geen samenwerking met de vereniging Veilig Verkeer (verder VVV) in het kader van voorlichting. Tussen het KPC en UOOW is er gebrek aan eensgezindheid in opvatting met betrekking tot de veiligheid en dit leidt ertoe dat er geen overleg wordt gepleegd bij de aanleg van de benodigde infrastructuur. De verkeersveiligheid is hiermee niet gediend.

In de wetgeving worden een aantal onderwerpen onvoldoende geborgd en daarnaast zijn bepaalde onderwerpen niet (in de wet) geregeld. Zo is er bijvoorbeeld geen regeling over kentekenaansprakelijkheid om het rijden door roodlicht en overschrijding van de snelheid effectief aan te pakken. Ook zijn er geen technische eisen gesteld voor motoren om het verrichten van technische aanpassingen (zweefarm) te verbieden teneinde het fenomeen “fever” effectief aan te pakken. Verder ontbreken een landsbesluit kentekenregister en een regeling vergelijkbaar met de Nederlandse wet Mulder om overtredingen via bestuursrechtelijk kanaal af te handelen. Er is een concept-regeling opgesteld en ingediend door een werkgroep bij het ministerie van justitie maar dit concept is niet vastgesteld.

Verder blijkt dat er geen (integraal) strategisch beleid over verkeersveiligheid is opgesteld. Er zijn wel doelstellingen gesteld in de plannen van het KPC en het OM om controles uit te voeren. Structurele gerichte controle ten aanzien van al de gestelde verkeersthema’s ontbreekt.

De middelen die het korps ter beschikking heeft blijken op het moment onvoldoende te zijn om de verkeerswetgeving effectief te handhaven. Er is een gebrek aan adequate geavanceerde (technische) middelen zoals fieldtesters en ademanalyse apparaat om alcohol controles uit te voeren. Het Actpolsysteem van het KPC produceert geen management informatie en bevat ook geen applicatie “verkeer”. Het systeem wordt door een stichting beheerd en het verstrekken van management informatie verloopt moeizaam. Verkeerscontroles worden derhalve niet op basis van het IGP-concept uitgevoerd maar louter op eigen keuze of beleving. Ook blackspots worden niet op basis van (digitale)management informatie bepaald. Het ministerie van justitie is met een pilot project begonnen om camera’s voor de controle op het verkeer te plaatsen.
Er is een OvJ en een parketsecretaris speciaal belast met verkeerszaken. De kwaliteit van de Opv’s die door het korps worden aangeleverd is sterk verbeterd. Bij de UOOW heeft geen traffic engineer (verkeerskundige) om infrastructurele aanbevelingen te geven maar wel projectleiders die de basis van weg- en waterbouw hebben gestudeerd. Kennisverwerving geschiedt middels zelfstudie en deelname aan conventies. De URO&P heeft in tegenstelling tot de formatie geen planoloog.

Bij de ruimtelijke planning wordt (weinig) rekening gehouden met de infrastructuur voor het verkeer en daardoor kunnen moeilijk multimodale verkeersinfrastructuur worden aangelegd. De UOOW zorgt zoveel mogelijk voor voldoende wegmeubilair zoals verkeersborden, vangrails en lichtpalen en om snelheid beperkende voorzieningen te treffen zoals het aanleggen van rotondes, verhoogde kruisingen en verkeersdrempels (speed cushions) en markeringen van wegen. De overheid heeft op de begroting ingekort. Het overgrote deel van de beschikbare financiën wordt gebruikt voor onderhoud van infrastructuur.

Er zijn richtlijnen opgesteld door de Unit Verkeer van het korps voor de controle van: rijden onder invloed van alcohol, “fever/drift”, snelheid, autogordel en roodlicht. De richtlijnen zijn echter, met uitzondering van het personeel van HIT, onvoldoende bekend bij de Handhaving teams van het korps.

Doordat er geen structurele (gerichte)controles worden gehouden op het gebruik van alcohol, “fever” en valhelm zijn er geen concrete resultaten over deze thema’s. Er zijn slechts incidentele gevallen waarbij een bekeuring is uitgeschreven. Verder is er geen analyse over de trends met betrekking tot de geprioriteerde doelstellingen beschikbaar.
